1. Acceptance of Terms
Welcome to SoCalForeclosures.net (“Platform,” “Service,” “we,” “us,” or “our”). By creating an account, accessing, or using the Platform in any way, you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, do not use the Platform.
These Terms constitute a legally binding agreement between you and SoCalForeclosures.net. We may update these Terms from time to time as described in Section 15 below. Your continued use of the Platform after any such changes constitutes your acceptance of the revised Terms.
2. Account Registration & Eligibility
To use the Platform, you must register for an account and provide accurate, complete information. You must be at least 18 years of age and legally capable of entering into binding contracts. By registering, you represent and warrant that:
- You are at least 18 years old.
- All registration information you provide is truthful, accurate, and complete.
- You will maintain the accuracy of your information and update it promptly if it changes.
- You are responsible for maintaining the confidentiality of your account credentials.
- You accept responsibility for all activities that occur under your account.
- You will notify us immediately of any unauthorized use of your account.
We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion if we believe any information provided is inaccurate, incomplete, or violates these Terms.
3. Description of Services
SoCalForeclosures.net is an AI-powered property intelligence platform that aggregates, analyzes, and presents information about distressed and foreclosure properties across the 10 counties of Southern California. Our services include, but are not limited to:
- Pre-NOD (Notice of Default) distress detection using artificial intelligence and public record analysis.
- Property search and filtering tools for foreclosure, pre-foreclosure, and bank-owned (REO) properties.
- Distress Score™ ratings — a proprietary composite metric estimating seller distress level.
- Exclusive and priority lead claim systems with time-limited access windows.
- Deal pipeline CRM tools for tracking properties from discovery through closing.
- Real-time SMS and in-app alerts for new property matches.
- Leaderboard and engagement features.

The Platform does not provide legal advice, financial advice, investment advice, tax advice, or real estate brokerage services. All information provided through the Platform is for informational purposes only. You should consult qualified licensed professionals before making any real estate investment decisions.
4. Subscription & Billing Terms
Access to the Platform requires a paid subscription. By subscribing, you agree to the following billing terms:
- Monthly Fee: The current subscription rate is $149.99 per month. Founding Member pricing may be locked in at a fixed rate as specified at the time of your registration.
- Auto-Renewal: Your subscription will automatically renew on a monthly basis unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period.
- Billing Cycle: Your billing cycle begins on the date of your initial subscription and renews on the same date each subsequent month.
- Payment Methods: We accept major credit cards, debit cards, and other payment methods as made available through our payment processor. You are responsible for keeping your payment information current.
- Failed Payments: If a payment fails, we may attempt to charge your payment method again. If payment remains unsuccessful, your account may be suspended or downgraded after a grace period.
- Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation, you will retain access to the Platform through the end of your current billing period. No prorated refunds will be issued for partial billing periods.
- Price Changes: We reserve the right to change subscription pricing at any time. Existing subscribers with locked-in Founding Member pricing will not be affected by general price increases. Any price change for non-Founding members will be communicated at least 30 days in advance.
5. Credit System
The Platform uses a credit-based system for certain features, including lead claims. The following terms apply to credits:
- Monthly Allocation: Active subscribers receive 100 credits per month, included with their subscription.
- Rollover: Unused credits may roll over to the next month, up to a maximum balance of 300 credits. Any credits exceeding this cap are forfeited.
- Credit Usage: Credits are consumed when claiming leads. The credit cost varies depending on the lead tier (e.g., Exclusive leads cost 25 credits, Priority leads cost 10 credits, Open leads cost 1 credit).
- Non-Refundable: Credits are non-refundable and have no cash value. Credits cannot be transferred, sold, or exchanged between accounts.
- Forfeiture: If your subscription lapses and remains unpaid for more than 60 days, all accumulated credits will be permanently forfeited.
- Additional Credits: We may offer the ability to purchase additional credits in the future. Any such purchases will be subject to additional terms communicated at the time of purchase.
6. Exclusive Lead Claims
The Platform offers time-limited exclusive access to certain property leads. By claiming a lead, you acknowledge and agree:
- Exclusive Window: Newly detected leads may have an exclusive claim window (typically 24 hours) during which only one user may claim the lead.
- Time-Limited Access: Exclusive claims provide access for a defined period (typically 36 hours). After the exclusive period expires, the lead may become available to other users.
- Non-Transferable: Lead claims are personal to your account and are non-transferable. You may not sell, assign, or share your claimed leads with other users or third parties.
- No Guarantee: Claiming a lead does not guarantee that you will be able to contact the property owner, negotiate a deal, or close a transaction. The Platform provides information only — the outcome of any deal depends entirely on your own efforts and external factors beyond our control.
- Credit Consumption: Credits spent to claim a lead are consumed at the time of the claim and are not refundable, regardless of whether the lead results in a successful transaction.
7. Acceptable Use Policy
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Resell, redistribute, sublicense, or commercially exploit any data, content, or information obtained through the Platform without our prior written consent.
- Use automated scripts, bots, crawlers, scrapers, or any other automated means to access the Platform or extract data from it.
- Share your login credentials with any other person or allow multiple individuals to access the Platform through a single account.
- Attempt to circumvent, disable, or interfere with any security features of the Platform.
- Use the Platform to harass, threaten, or intimidate property owners or any other individuals.
- Misrepresent your identity, affiliation, or the nature of your business when using information obtained through the Platform.
- Violate any applicable local, state, national, or international law or regulation, including but not limited to California foreclosure laws and consumer protection statutes.
- Upload or transmit any viruses, malware, or other harmful code.
- Interfere with or disrupt the Platform or the servers and networks connected to it.
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account, forfeiture of credits, and potential legal action.
8. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, data compilations, software, algorithms, and the Distress Score™ methodology — are the exclusive property of SoCalForeclosures.net or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
- “Distress Score™” is a proprietary metric and trademark of SoCalForeclosures.net. You may not use this term or methodology in any manner that suggests affiliation with or endorsement by us.
- Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial investment research purposes.
- You may not copy, modify, distribute, sell, or lease any part of the Platform or its content, nor may you reverse-engineer or attempt to extract the source code of the Platform.
9. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, DATA, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- Warranties regarding the accuracy, completeness, reliability, or timeliness of any data, property information, Distress Scores, or other content provided through the Platform.
- Warranties that any property information reflects current conditions, ownership status, or legal encumbrances.
Property data is sourced from public records and third-party sources. We do not independently verify property information and make no guarantees as to its accuracy or completeness. Data may be delayed, incomplete, or contain errors. You are responsible for independently verifying all property information before making any decisions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOCALFORECLOSURES.NET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities.
- Losses arising from investment decisions made based on information obtained through the Platform.
- Losses arising from missed or failed real estate transactions.
- Losses caused by inaccurate, incomplete, or outdated property data.
- Losses caused by service interruptions, downtime, or technical failures.
- Losses caused by unauthorized access to your account.
In no event shall our total cumulative liability exceed the amount you have paid to us in subscription fees during the twelve (12) months immediately preceding the event giving rise to the claim. This limitation applies regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or any other legal theory.
11. Indemnification
You agree to indemnify, defend, and hold harmless SoCalForeclosures.net, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
- Your use of or access to the Platform.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any real estate transaction or investment decision you make based on information obtained through the Platform.
- Your interaction with property owners, sellers, or other third parties in connection with leads obtained through the Platform.
- Any content or information you submit to or through the Platform.
12. Account Termination
Termination by Us: We reserve the right to suspend or terminate your account, at our sole discretion, at any time and for any reason, including but not limited to:
- Violation of these Terms or the Acceptable Use Policy.
- Fraudulent, abusive, or illegal activity.
- Non-payment of subscription fees.
- Extended period of account inactivity (180+ days).
- Requests from law enforcement or government agencies.
Termination by You: You may delete your account at any time through your account settings or by contacting support at support@socalforeclosures.net. Upon account deletion:
- Your subscription will be cancelled and no further charges will be made.
- You will lose access to the Platform immediately.
- All remaining credits will be permanently forfeited.
- Your personal data will be handled in accordance with our Privacy Policy.
13. Dispute Resolution & Arbitration
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Los Angeles County, California. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration against SoCalForeclosures.net.
Exception: Either party may bring a claim in small claims court if the claim qualifies for small claims jurisdiction. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Modification of Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you at least 30 days before the changes take effect by:
- Posting the updated Terms on the Platform with a new “Last Updated” date.
- Sending an email notification to the address associated with your account.
- Displaying a prominent notice within the Platform.
Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Platform and cancel your subscription.
